The firms were charged with 26 counts of introducing adulterated and misbranded food into the USA. The Chinese firms — Xuzhou Anying Biologic Technology Development and Suzhou Textiles — supplied wheat flour that was sold as wheat gluten and had been tainted with melamine, an industrial chemical not allowed in food. Melamine made the gluten appear more protein rich and was cheaper than increasing the actual protein content, the indictments say. The indictments, announced by U.S. Attorney John Wood in Kansas City, Mo., allege that Suzhou falsely labeled at least some of the goods to avoid required inspections by Chinese officials before the products left China. The alleged deception also prevented a government inspection of the plant where the product was made, the indictments allege. Suzhou supplied the wheat gluten to ChemNutra, a Las Vegas importer. The indictments against ChemNutra and its owners, Sally Miller and her husband, Stephen Miller, also included a count of conspiracy to commit wire fraud. The indictments allege that Sally Miller, a Chinese national trained as a food chemistry engineer, knew that products coded incorrectly wouldn't be inspected by the Chinese, and her company did not inform its pet-food customers that Chinese inspections were not done. Wood said prosecutors aren't alleging that the Millers knew the product was toxic, only that they knew it had been exported to the USA under false pretenses, the Associated Press reported. The Millers "deny the allegations in the strongest of terms," said ChemNutra spokesman Steve Stern in a statement. The Millers had neither intent to defraud nor knowledge of fraud, he said. ChemNutra imported 13 shipments of the ingredient between November 2006 and February 2007, the indictments say. The tainted product led to the recall of more than 60 million cans of pet food and 150 brands of dog and cat food. Much of the recalled food was made by Menu Foods, a Canada-based private-label manufacturer. No official tally of dead or sick pets has been done. Six weeks after the recall started last March, the FDA said it had received unconfirmed consumer reports of 1,950 dead cats and 2,200 dead dogs. Dongsheng Zang, a professor of international law at the University of Washington in Seattle, says because there's no bilateral treaty between the U.S. and China covering these issues, "legally and practically" the indictments of the Chinese companies have no impact. The only recourse for the U.S. companies who lost money would be if their contracts included an arbitration clause. "The Chinese companies are probably liable under contractual terms," Zang said. The issue would go to an arbitration tribunal which, would decide liability. If the Chinese companies were found liable, the American companies would have to bring the award to a Chinese court, which "would have a legal obligation under international conventions to enforce it," Zang said.
